Mr.Vibhuti Nanavati, learned Counsel for the appellant, states that in view of the decision of the Full Bench of this Court in First Appeal No.1343 of 1988 and allied matters decided on 23.3.2012, since the issued is already covered, the appeal would not survive and he does not press the present appeal in view of the aforesaid decision of the Full Bench of this Court.
