Heard Sri Saurabh Srivastava, learned counsel for appellant and perused the record.
This appeal has been preferred against the judgment and award dated 15.01.2003 passed by Motor Accident Claims Tribunal/Additional District Judge, Etah (hereinafter referred to as 'Tribunal') in M.A.C.P. No. 178 of 1999 awarding a sum of Rs.65,000/- with interest at the rate of 9% as compensation to the claimant.
Even on the smallness of the amount and though the grounds are raised it is not proved before the Tribunal that there was any infraction of Section 147 of Motor Vehicles Act, 1988 and that the chargesheet is already laid against the driver of the vehicle. Involvement is admitted to be proved as per judgment in Pankaj Mithal.
The appeal is dismissed.
