(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after taking into consideration the fact that Union of India has preferred Special Leave Petition before the Supreme Court challenging a part of our order dated December 23, 2011, we stay the operation of our order dated April 19, 2012 passed in Misc. Civil Application No. 905 of 2012 till June 14, 2012 to enable the Union of India to get appropriate order from the Apex Court. We further make it clear that this order is subject to the condition that unchallenged part of our order dated December 23, 2011 must be complied with by making actual payment by the next date.
The application is disposed of in the above terms.
