This appeal has been preferred against the interim order. The interim order was passed ex parte with a direction to serve notice on the Additional Solicitor General of India. The Additional Solicitor General of India has informed about pendency of the application to seek vacation of the stay order. The application is listed before the learned Single Judge today itself. He prays for an appropriate direction for hearing of the the application because the injuries shown by the petitioner/non-appellant to have incapacitated to challenge the transfer order does not exist.
In view of the fact that an application to seek vacation of the stay order has already been filed, we find it appropriate to direct the office to list the application before the learned Single Judge within two weeks from today by placing it in first ten cases, if the application is not heard and disposed of today by the learned Single Judge.
With the aforesaid, appeal is disposed of without causing interference in the interim order as the application for vacation would be heard and decided by the learned Single Judge.
