Heard learned counsel for the petitioners and Sri Vinod Kumar Agarwal, learned counsel for the respondent.
Present petition has been filed challenging the judgment and decree dated 19.09.2018 passed by Additional Judge Small Causes Court, Agra in SCC Suit No.16 of 2016 (Ravi Kant Agarwal Vs. Union of India and others) as well as judgment and decree dated 30.09.2019 passed by Additional District Judge, Court No.6, Agra in SCC Revision No.50 of 2018 (Union of India and others Vs. Sri Ravi Kant Agarwal).
After some argument, learned counsel for the petitioners submitted that he does not want to press the petition and petitioners may be granted one year time to vacate the building in question, which was objected by the learned counsel for the respondents.
Thereafter, considering this facts and circumstances, petitioners are granted six months time to vacate the building in question from today. He is also directed to file an undertaking before the Additional Judge Small Causes Court, Agra to this effect. In case, undertaking is not filed, respondent is at liberty to proceed in accordance with law against the petitioner for eviction and possession of building in question.
With the aforesaid observations, the petition is dismissed. Order Date :- 17.12.2019 Junaid
