Heard Sri Rajesh Tripathi, learned counsel for the Union of India (Petitioners). Sri Hare Ram Pandey has appeared for contesting respondent no. 1.
The challenge in this petition is to the judgment and order dated 12.5.2017 passed by the Central Administrative Tribunal (Lucknow Bench) allowing the claim of the contesting respondent no. 1 whose services were terminated by taking recourse to Rule 8 of Gramin Dak Sewak (Conduct and Engagement) Rules, 2011.
The termination order of respondent no. 1 was set aside and he was directed to be reinstated with all consequential benefits.
A large number of similar Original Applications of the Gramin Dak Sewak came to be decided by the tribunal vide judgment and order dated 14.7.2017.
The aforesaid judgment and order was the subject matter of challenge before the High Court in atleast 61writ petitions and they were decided by the High Court vide judgment and order reported in 2019 (1) UPLBEC 41 Union of India and others Vs. Archana Mishra and all the writ petitions were dismissed upholding the judgment and order of the tribunal.
Learned counsel for the parties agree that the controversy involved in this writ writ petition is squarely covered by the above decision.
Accordingly, this writ petition is also dismissed in the same terms and conditions as contained in the above- referred judgment.
