1. Heard learned advocates for both the sides and perused the papers on record. The workman was terminated in the year 1984. The award was passed by the Industrial Government Tribunal cum Labour Court in the year 2012 which is impugned in this petition.
2. Having considered the facts and circumstances of the case, since the matter has already been admitted, the following order is passed:
The retirement dues as directed by the Tribunal cum Labour Court shall be deposited by the petitioner before the Registry of this Court within a period of four weeks from today.
Out of the said amount, the total amount of gratuity as well as pension admissible and due to the workman shall be paid to the respondent within four weeks from today.
The remaining amount shall be invested by the Registry with a nationalised bank for a period of one year and shall be renewed every year till the final result of this petition.
The interest accruing on the same shall be paid to the respondents quarterly.
It is clarified that the pension shall be payable to the respondent with effect from 01.07.2012.
If the regular pension is not paid on or before 31.03.2013, it shall be open to the respondent to initiate contempt proceedings in this matter.
Direct service is permitted to the respondent.
