Union Of India Thru Its Secy & Ors vs Uma Shankar Singh Chandel And Anr

High Court Of Judicature at Allahabad|26 April, 2018

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 14774 of 2013 Petitioner :- Union Of India Thru Its Secy & Ors. Respondent :- Uma Shankar Singh Chandel And Anr. Counsel for Petitioner :- B.K.Singh Raghuvanshi,R.B. Singhal Counsel for Respondent :- R.K.Shukla
Hon'ble Sudhir Agarwal,J. Hon'ble Ifaqat Ali Khan,J.
1. This is thoroughly misconceived and ill advised writ petition. Learned counsel for petitioner at the very out set stated that the applicant-respondent was guilty of concealment of fact that he was removed from service at Vehicle Factory, Jabalpur and got employment by concealment of above fact at Ordinance Factory, Kanpur, but record shows that removal order passed at Vehicle Factory, Jabalpur was set aside by Management itself on 10.12.1979 and once order was set aside, removal becomes non-est. Hence there was no question of any declaration by applicant-respondent while seeking subsequent employment and this cannot be said to be concealment of fact. Learned counsel for petitioner, therefore, has made a wrong statement before Court and we do not appreciate this kind of statement.
2. Despite repeated query no other reason could be shown to assail impugned judgment of Tribunal. We, therefore, find no manifest error in the impugned judgment assailed in this writ jurisdiction, and the same warrants no interference.
3. The petition stands dismissed with costs quantified at Rs. 20,000/-.
