JUDGMENT / ORDER

Hon'ble Abhai Kumar,J.
The Tribunal by order dated 5 September 2016 after noticing the statement that has been made by the employer that the case of Mohd. Naeem was under consideration, instead of directing for considering the case of the applicant, passed an order directing that the applicant should be appointed on compassionate ground as and when the first vacancy occurs.
The matter requires consideration.
Issue notice to respondent no.1 by registered post. Steps may be taken within a week.
The respondents may file their counter affidavits in four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List this petition on 15 February 2017.
Till the next date of listing, the direction issued by the Tribunal that the applicant (respondent no.1) should be appointed on compassionate ground as and when the first vacancy occurs, shall remain stayed.
It shall, however, be open to the petitioner to consider the case of the respondent for appointment on compassionate ground afresh in accordance with law.
