This anticipatory bail application has been filed on behalf of the applicants seeking anticipatory bail in Case Crime No. 414 of 2020, under Section - 3/5A/8 Cow Slaughter Act & 11 Animal Cruelty Act & 429 I.P.C., Police Station - Bairiya, District - Ballia, during the pendency of trial.
In this case, it so happened that as per the description contained in the F.I.R., the police caught several pick up vehicles, which are numbered as UP60 AT 3474, BR04 GA 8516, BR04 GA 9549 and BR04 GA 7296, wherein cattle were kept in great number, due to which several animals/cows died. The applicant was owner of one of the aforesaid vehicle, say BR04 GA 7296. Reasons assigned by the applicant that he did not allow it to the driver, who unauthorizedly used the vehicle of the applicant would not alone absolve him from ownership liability, for the reason that the applicant has not taken any legal action against the driver concerned, who unauthorizedly used the aforesaid vehicle of the applicant. It being so, the applicant does not deserve any sympathy.
Consequently, the instant anticipatory bail application is
dismissed.
Nothing has been observed on the merit of the case.
