Heard learned counsel for the petitioner, learned Standing Counsel for first and second respondent and Sri Arun Kumar, learned counsel for the third respondent.
Notice need not issue to the fourth respondent in view of the order proposed to be passed.
By the instant writ petition, petitioner seeks the following prayer:
"I. a writ, order or direction in the nature of mandamus commanding the respondents to take appropriate decision on the representation dated 16.04.2018 and 30.12.2018 filed by the petitioner for closing un- recognized School of respondent no. 4, expeditiously within time frame as may be fixed by this Hon'ble Court."
The fourth respondent is running and managing P.N. Memorial Public School, Village Ranapar, Post Vishunpura, Brahmpur, District Gorakhpur.
It is urged that the third respondent, District Basic Education Officer, Gorakhpur vide communication dated 20 August 2018 directed the fourth respondent to windup the school as the same is not recognized under the Act and further directed directed that the students studying therein be admitted to the nearby school run and managed by the Basic Shiksha Parishad.
The instant writ petition has not been filed in public interest, in any case if the school is being run authorizedly, it is for the parents and for the Educational Authorities to decide the course of action and to take remedy in accordance with law.
On the specific query, learned counsel for the petitioner submits that he is a resident of the village but admits that his children are not studying in the said school.
In view thereof, the Court declines to grant the relief prayed for.
The writ petition being devoid of merit is, accordingly, dismissed.
