Heard learned counsel for the petitioner and the learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 227 of 2010, under Section 406 IPC, police station Kotwali Dehat Gonda, District Gonda.
We have gone through the FIR .
It is argued by the learned counsel for the petitioner that incident is said to have been committed on 11.06.2005 and the FIR has seen light of the day on 10.06.2010 it clearly goes to show that the same has been lodged with ulterior motive.
Let the things be as they are, in the aforesaid facts and circumstances of the case, we dispose of the writ petition finally with the direction that the petitioner shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against him, provided he cooperates with the investigation, which shall go on.
