Heard learned counsel for the applicant and learned A.G.A. for the State.
The instant application under Section 482 Cr.P.C. has been filed for quashing the impugned charge-sheet dated 27.7.2018 alongwith cognizance order dated 22.4.2019 as well as entire criminal proceeding of Case No.3328 of 2019 (State Vs. Umesh Singh) arising out of Case Crime No.90 of 2018, under Sections 304-A, 201 I.P.C, Police Station Jhangaha, District Gorakhpur pending in the Court of Chief Judicial Magistrate, District Jaunpur.
Learned counsel for the applicant submits that there is contradiction in the statements; the allegations prima facie does not appear to be correct.
On specific query, learned counsel for the applicant is unable to show from the material brought on record that prima facie allegations of commission of the offence or the ingredients of the offence is not made out against the applicant.
The petition being devoid of merit is accordingly, dismissed.
