JUDGMENT / ORDER

Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to direct the release the petitioners on bail in the event of their arrest pursuant to registration of Crime No. 99 of 2014 of Miyapur Police Station, Cyberabad pending enquiry and trial.
The petition coming on for hearing, upon perusing the Petition and the Memo of Grounds filed herein, and upon hearing the arguments of Smt S. Vani, Advocate for the Petitioner and of the Public Prosecutor on behalf of respondent-State, the Court made the following ORDER :-
The petitioners are A1 and A3. They seek for grant of anticipatory bail. They allegedly committed offences under Section 419 and 420 IPC. As the offences are triable by a Magistrate of First Class, it would be appropriate for the petitioners to surrender before the trial Court and move the trial Court for grant of regular bail.
However, the second petitioner is a lady. She is described to be 23 years old. In view of the age and sex of the second petitioner and the nature of the offences alleged against her, I consider it appropriate to enlarge the second petitioner on anticipatory bail.
Consequently, this Petition is allowed so far as second petitioner is concerned. The second petitioner shall surrender before the learned IX Metropolitan Magistrate, at Kukatpally, within two weeks from today. On such surrender, the learned IX Metropolitan Magistrate, at Kukatpally, shall enlarge the second petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.

So far as the first petitioner is concerned, this Criminal Petition is disposed of giving liberty to the first petitioner to surrender before the trial Court and move the trial Court for grant of regular bail. In such an event, the Trial Court shall consider such an application on merits, without being influenced by any part of this order, and shall dispose of the same on the same day on which it is filed.”
