Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with a prayer to direct the Sub Divisional Magistrate, Tehsil Padrauna District Kushinagar to complement the order dated 12.3.2011 passed by the Commissioner, Gorakhpur Mandal Gorakhpur (respondent no. 2) in accordance with law.
Pursuant to the order dated 12.9.2018, learned Standing Counsel Sri Rajesh Kumar has placed a copy of the instructions so received by him. According to the instructions as on date there is a legal impediment in implementation of the order dated 12.3.2011 as in a petition filed before this Court the petitioner herein is petitioner no. 4 therein.
Learned counsel for the petitioner sought to dispute the same, however, could not dispute this fact.
In such view of the matter, I find that there appears to be some legal impediment in implementation of the order dated 12.3.2011. As such, no mandamus as has been prayed for can be issued.
Present petition is accordingly dismissed. No order as to costs.
