Sri Pradeep Kumar Mishra, learned counsel for the appellant, and Mrs. Archana Singh, learned A.G.A. are present.
Learned counsel for the appellant submitted that though the appellant namely, Umesh Kushwaha @ Baba has been granted bail vide order dated 15.3.2019 directing the appellant to be released on bail on his a furnishing personal bond with two heavy sureties (one should be of their family member) each in the like amount to the satisfaction of the court concerned but he has not yet been released as he could not arrange surety of his family member.
The said order is modified as follows:-
The appellant Umesh Kushwaha @ Baba convicted and sentenced in S.T. No. 49 of 2014, arising out of Case Crime No.220 of 2014, under sections 363, 366, 328/34, 368, 376-D, 506 IPC, Police Station Akbarpur, District Kanpur Dehat be released on bail on his furnishing a personal bond with two heavy sureties (one should be close relative) each in the like amount to the satisfaction of the court concerned.
Accordingly, the modification application is disposed of.
