In compliance of order dated 23.01.2018, Sri Mukesh Kumar Singh, District Inspector of Schools, Lucknow is present in person.
Sri Ran Vijay Singh, learned Additional Chief Standing Counsel has produced the judgment and order dated 13.07.2015 passed by the Division Bench of this Court in Special Appeal Defective No.266 of 2015; State of U.P. & others vs. the U.P. Pradhanacharya Parishad Lko. & another. By means of the aforesaid judgment, the Division Bench of this Court was pleased to allow the special appeal of the State setting aside the judgment and order of learned Single Judge dated 16.09.2014 permitting the private respondents to adopt suitable proceedings in accordance with law in regard to the validity of Regulation 101. It has further been observed that since the writ petitions challenging constitutional validity of Regulation 101 are pending, therefore, there is no occasion to express any view on the legality of that provision.
It has been informed at the bar that couple of writ petitions challenging the constitutional validity of Regulation 101 are still pending before this Court at Lucknow as well as at Allahabad, both.
Learned counsel for the petitioner has however requested that he may be granted a week's time to address the Court on the aforesaid point by way of judgment of this Court as well as of the superior court.
List this petition on 30.01.2019 for peremptory hearing.
The District Inspector of Schools, Lucknow, who is present before this Court today, need not to appear on the next date unless called for by a specific order of this Court, as his appearance is exempted.
