This application u/s 482 Cr.P.C. has been moved seeking the quashing of charge sheet no.315/2015 dated 27.12.2015 and cognizance order dated 24.02.2016 as well as entire proceedings in Criminal Case No.24/2016 (State vs. Avadhesh) arising out of Case Crime No.481 of 2015, u/s 354 I.P.C., P.S.- Khandauli, District-Agra pending in the court of Additional Chief Judicial Magistrate, Court No.9, Agra.
Heard learned counsel for applicant and learned A.G.A. and also perused the record.
According to the counsel for applicant, the applicant is not nominated neither as accused in the F.I.R. nor his name surfaced during the course of investigation nor the charge sheet was submitted against him. The charge sheet has been submitted against several other persons. If the submission of counsel is true then it is difficult for this Court to appreciate the maintainability of this application which seeks the quashing of the charge sheet. In absence of complete record this Court is not in a position to assess any justification behind filing this application. If the applicant is not connected with the crime, how shall he be any locus to file this application seeking the quashing of the charge sheet.
Application being meritless stands dismissed.
