Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 10.01.2017 registered as Case Crime No. 14 of 2017 at P.S. Jigna, District- Mirzapur, under Sections 3 (1) of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986.
The impugned first information report has been lodged in the year 2017 and it appears that the petitioner has already obtained bail in the matter.
The contention of the learned counsel for the petitioner is that some opinion has been provided as per which a case prosecution under the Gangster Act is not made out.
If that is so, if a charge-sheet is submitted then the petitioner may seek for discharge.
With the aforesaid liberty, the petition stands disposed off.
It is made clear that this court has not expressed any opinion whether a case for discharge is made out or not.
