Heard learned counsel for parties.
The District Inspector of Schools by an order of 06 April 2021 had proceeded to approve an order of suspension passed by the fourth respondent. As would be evident from a reading of the aforesaid order, the petitioner came to be suspended on 07 February 2021 consequent to his conviction in Case Crime No. 125 of 2011. The judgment of conviction was assailed by the petitioner in Criminal Revision No. 2193 of 2020. By an interim order of 17 June 2021 the order confirming sentence as well as conviction has come to be placed in abeyance. It is in the aforesaid backdrop that learned counsel for the petitioner contends that the order of suspension is liable to be reviewed.
Sri Ajitabh Choubey learned counsel representing the fourth respondent states that subject to verification of the aforesaid facts, the prayer for revocation of the order of suspension shall be duly examined and a final decision communicated with expedition and preferably within a month from today. He further states that the decision so taken shall thereafter be placed before the second respondent for passing appropriate orders. The grievance of the petitioner of even subsistence allowance having not been paid till date shall also be examined by the fourth respondent within the period stipulated above.
In view of the aforesaid, the petition shall stand disposed of in the above terms. All contentions of respective parties on merits are kept open.
