Notice on behalf of respondents has been accepted by the office of learned Government Advocate.
Let counter affidavit be filed by the respondents within four weeks. Two weeks' time thereafter shall be available to the learned counsel for the petitioner to file rejoinder affidavit.
List this case after expiry of the aforesaid period.
It has been contended by the learned counsel appearing for the petitioner that the impugned show cause notice dated 30.07.2021, issued by the Additional District Magistrate, District Amethi, which is contained as Annexure No. 1 to the writ petition is vague and it does not conform to the law laid down by a Full Bench of this Court in the case of Bhim Sain Tyagi Vs. State of U.P. and others, Allahabad Criminal Cases 1999(Vol.39) 321.
In these circumstances, we provide that though the proceedings pursuant to the show cause notice shall go on and the petitioner shall accordingly submit his reply to the said show cause notice, however, till the next date of listing, no final order shall be passed by the authority concerned.
