Heard Sri Santosh Kumar Dubey, learned counsel for the petitioner and Sri Vrindavan Mishra, learned counsel appearing for the Ghaziabad Development Authority, Ghaziabad.
By this writ petition the petitioner has prayed for quashment of notices dated 03.12.2018, 20.12.2018 and 25.01.2019 issued by Respondent No.3, wherein it has been stated that some illegal construction has been made without permission of the authority concerned.
Learned counsel for the petitioner has submitted that petitioner has filed a representation and the matter is pending for consideration before the authority concerned. It is also submitted by the petitioner that on 01.01.2019 the petitioner's shop was sealed and at present the matter is pending before the authority concerned.
Against the sealing order a statutory remedy is available by filing an appeal, therefore, we are not inclined to issue any direction to the authority concerned. The writ petition filed by the petitioner is pre-mature. The petitioner is at liberty to avail the statutory remedy as available to him under the provisions of the U.P. Urban Planning Development Act, 1973.
With the aforesaid observation the writ petition is disposed of.
