The order of transfer dated 31.5.2018, by which petitioner has been transferred from District Hamirpur to District Etah, is challenged on the ground that the petitioner has not been paid salary for the last 10 months and in respect of such grievance, he has already approached this Court by filing Writ Petition No. 11127 of 2018. It is submitted that the person, who was working at Etah, has not yet been relieved.
Learned Standing Counsel submits that the petitioner has remained posted at Hamirpur for sufficiently long.
Learned counsel for the petitioner does not dispute the fact that the petitioner is continuing at Hamirpur for the last more than 10 years. So far as grievance relating to denial of salary for more than 10 months is concerned, this Court has already issued directions in Writ Petition No. 11127 of 2018, in that regard.
In such circumstances, once the petitioner holds a transferable post and transfer is not shown to be violative of any statutory rule or suffers from any malafide, no interference with it is called for. Petitioner's grievance regarding his joining at transferred place shall be considered, by the competent authority as soon as petitioner offers his joining.
Writ petition fails and is accordingly dismissed.
