Submission is that petitioner is entitled to be appointed as Constable (GD) pursuant to recruitment exercise initiated by the Commission in the year 2011.
Sri Gyan Prakash, learned counsel appearing for the authorities of the Union of India points out that petitioner has only scored 47 marks, whereas the cut-off in the OBC category was 58 marks.
Since petitioner has scored marks below the cut-off in the respective category, no exception can be taken if he is not selected. Even otherwise, there is no explanation as to why petitioner has approached this Court after four years, particularly when the recruitment exercise itself has been concluded.
Writ petition is, accordingly, dismissed.
