Petitioner's unmarried sister has died while in harness on 29.9.2015. The nominee in the service records was the mother, who has also died on 12.5.2017. Petitioner, who is brother, is the only surviving heir alongwith two other married sisters. Petitioner has made a claim for release of dues payable to petitioner's sister, before the authority concerned, but no decision has yet been taken. Hence, this petition.
Sri A. C. Srivastava, learned counsel for the District Basic Education Officer concerned submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim, noticed above, in accordance with law, by means of a reasoned order to be passed, within a period of four months from the date of presentation of certified copy of this order.
It is clarified that this Court has not adjudicated the claim of petitioner on merits, and all issues are left open to be considered by the authority concerned, at the first instance.
