The present writ petition has been moved for issuance of a writ in the nature of mandamus commanding the respondent no. 2- Consolidation Commissioner to take final decision in the matter while exercising its powers under section 6 of the Consolidation of Holdings Act (hereinafter referred to as the Act).
It is submitted by the counsel for petitioner that notification under section 4(2) of the Act was issued on 11.7.2014. Prior to the said notification, the land in question was declared as an urban area under the Urban Planning and Development Act vide notification dated 14.6.2006. It is further submitted that representation in this regard has been given to the Consolidation Commissioner to take decision in the matter by issuing notification under section 6 of the Act but inspite of the representation, no heed has been paid by the Consolidation Commissioner.
After hearing learned counsel for the parties and considering the facts and circumstances of the case, the petitioner is permitted to make a fresh representation in regard to his grievances before the respondent no. 2- Consolidation Commissioner, within three weeks from today. In the event any such representation is made by the petitioner, the respondent no. 2 -Consolidation Commissioner is directed to consider the same and pass appropriate order in accordance with law expeditiously within a period of six months from the date of receipt of said representation alongwith certified copy of this order.
With the above directions, the writ petition stands finally disposed of. No order as to costs.
