Sri Y.K. Yadav, learned counsel for the petitioner and Sri Girish Vishwakarma, learned Standing Counsel for the State.
Petitioner's grievance is that respondent nos. 2 and 3 have made encroachment over drain (Nali) over plot no. 441 and 445 situated in village and post Ghoredeeh, Tehsil Karchhana, District Prayagraj.
This writ petition can be disposed of with a direction to respondent no. 1, the District Magistrate, Prayagraj that in case petitioner moves a representation before him complaining encroachment over public land then the District Magistrate shall get inquiry conducted through a competent SDM within 30 days of such representation and if it is found that there is any encroachment on the public land then action be taken for removal of encroachment within further period of 45 days.
In above terms, the writ petition is disposed of.
It is made clear that in case District Magistrate finds that complaint made by the petitioner is false and frivolous that the District Magistrate will be free to take suitable action against he petitioner.
