Heard learned counsel for the applicant and learned A.G.A. for the State.
This application has been filed to quash the order dated 12.11.2018 passed by Family Judge/FTC-Ist Bareilly in Misc, Case No. 964 and 965 of 2017 (Javitri vs, Umesh) under section 125(3) Cr.P.c. P.S. Baheari District Bareilly.
The submission is that applicant has complied the order dated 27.8.2018 passed in criminal revision no.2828 of 2018 on 27.8.2018, even then recovery has been issued against him. The order dated 12.11.2018 does not discloses as to how amount has been recovered and for what period.
This application is disposed directing the applicant to make an application before the Family Court pointing out above fact. The court below shall pass appropriate order thereon in accordance with law within one month from the date of production of certified copy of this order.
Till the decision is taken by the court below the order dated 12.11.2018 passed by the court blow shall be kept in abeyance.
