Heard Shri Ram Pratap Yadav, learned counsel for the petitioner; Shri Abhishek Shukla, learned Standing Counsel for the State respondent nos.1 to 4 and Shri R.C. Upadhyay, learned counsel appearing for the Gaon Sabha.
The petitioner is before this Court with request to issue direction to the third respondent, Sub Divisional Magistrate, Tehsil Sadar, District Azamgarh to decide his application dated 30.10.2012 filed under Section 161 of UP ZA & LR Act within stipulated time and to direct the respondent authorities to maintain status quo in regard to the land in dispute till disposal of the application.
Learned Standing Counsel fairly states that in case the aforesaid application is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the third respondent to decide the aforesaid application, as expeditiously as possible and preferably within a period of four months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost.
