Heard Sri Sanjay Kumar Dwivedi, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for directing the court below/ A.C.J.M.-I, Mathura to decide the Case No. 2240/IX of 2014, (Smt. Umarani Vs. Mathuresh Sharma), U/s 138 N.I. Act, Police Station Sureer, District Mathura, pending in the court of A.C.J.M.-I, Mathura, within stipulated period.
Upon hearing parties counsel and perusal of record, the application under Section 482 Cr.P.C. is disposed of with a direction to the learned Magistrate, Mathura to dispose of the Complaint Case No.2240/IX of 2014 expeditiously, if possible within one year after ascertaining the presence of OP No.2, who is absconding after obtaining bail since 7.5.2016 and making misuse of liberty of bail, by cancelling his bail and adopting effective and strict coercive measures for ascertaining his presence.
