Umar Mohammad Ghoghar vs State Of Gujarat &

High Court Of Gujarat|21 December, 2012

JUDGMENT / ORDER

By way of present petition, the convict has challenged the order dated 21.12.2012 passed by Inspector General (Prisons), State of Gujarat, by which, the application filed by the petitioner for furlough leave is dismissed.
It appears from the jail record that he remain absconded for 704 days when he was released by this Court on temporary bail in the year 2007 and came to be arrested in 2009. Again he absconded while he was released by this Court on parole leave in June 2011 and came to be arrested by the police after 140 days.
Considering the above aspect, I am of the opinion that the Authority has not committed any error in rejecting the application. Hence, the present application is dismissed.
