Heard Sri Pankaj Kumar Tiwari, learned counsel for the petitioner, learned Standing Counsel representing respondent nos.1 to 3 and perused the record.
After due deliberations at length, learned counsel for the petitioner has confined his argument only with respect to prayer no.(iii), which is being reproduced below :-
"(iii) Issue a writ, order or direction in the nature of mandamus directing the Tehsildar, Tehsil-Machhalishahar, Jaunpur to decide the Case no.05592 of 2020, Computer Case No.T202014360305592 under Section 67 of U.P. Revenue Code-2006 expeditiously in accordance with law within stipulated period."
Learned Standing Counsel has contended that he will have no objection, if this Court issues direction for early disposal of the case, which is pending before the authority concerned.
Seeing the limited prayer made by learned counsel for the petitioner, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition filed in the nature of Public Interest Litigation (PIL), without making any observation on the merits of the case as mentioned in the writ petition, with a direction to the Assistant Collector/Tehsildar (respondent no.3), before whom Case no.05592 of 2020, Computer Case No.T202014360305592 under Section 67 of U.P. Revenue Code-2006 is pending, to decide the same in accordance with law expeditiously, preferably within the period of three months from the date of receipt of a copy of this order.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observations, this petition is finally disposed of.
