The prayer made in the instant writ petition is for a writ of mandamus commanding respondent No. 2 i.e. Executive Engineer, Dakshinanchal Vidyut Vitran Nigam Ltd., to provide the electricity connection to the petitioner.
The case of the petitioner is that he filed an application on 05.02.2021 for grant of electric connection at his premises. On the said application, the electric connection has not been provided to the petitioner so far.
Sri Baleshwar Chaturvedi, appearing on behalf of respondent No. 2 submitted that there was theft of electricity at the premise in question. The father of the petitioner had earlier approached this Court by filing Writ No. 24804 of 2015 challenging the assessment order. The writ petition was dismissed vide order dated 30.04.2015 with liberty to the petitioner to challenge the assessment order in appeal. He thus tried to contend that for the above reasons, the electricity connection cannot be granted to the petitioner. However, he very fairly admits that till date no order has been passed on the application of the petitioner. He further states that respondent No. 2 will pass order on the application of the petitioner within three weeks.
Accordingly, the writ petition is disposed of with direction to respondent No. 2 to pass a speaking order on the application of the petitioner within three weeks and communicate the said order to the petitioner.
The petition stands disposed of accordingly.
