For Petitioners : Mr.J.Franklin O R D E R This Civil Revision Petition has been filed to direct the I Additional District Judge, Tiruppur to defer all further proceedings in M.C.O.P.No.930 of 2010 to end of September 2017.
2. It is the case of first petitioner, she is employed in MINNESOTA IT SERVICES(MNIT) in United States of America and in view of first petitioner's avocation, the employer has refused to grant leave during July, 2017. The employer of the first petitioner has further written a letter that the leave will be granted to her in the end of September or early October, 2017. The first petitioner/claimant filed M.C.O.P.No.930 of 2010 claiming compensation on the death of her husband.
3. Considering the facts and circumstances of the case, this Court feels that the request made by the claimant is genuine and the claim petition can be disposed of, after giving an opportunity to the claimants. Therefore, the trial Court can conduct the trial after a period of two months.
4. In view of the submissions made by the learned counsel for the petitioners, a direction is issued to the Motor Accident Claims Tribunal / I Additional District Judge, Tiruppur, to take up the trial in M.C.O.P.No.930 of 2010, pending on its file during the second week of October, 2017 and proceed with the same.
5. With this direction, this Civil Revision Petition is disposed of. No costs.
