Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent nos. 1 to 4 and perused the record.
The present petition has been filed seeking the following relief:-
"A. Issue a writ, order or direction in the nature of Mandamus direct the respondents No. 2, 3 and 4 to remove the encroachment of the passage passing from the shop situated on main crossing of the Village-Jewan, Tehsil-Puwayan, District-Shahjahanpur."
The grievance of the petitioner is that the respondent no. 5 is encroaching upon a public rasta causing nuisance to the petitioner.
For such grievance, the petitioner can take recourse to the provision of Section 133 Cr.P.C, 1973.
