Supplementary affidavit filed today is taken on record.
Heard Shri Gopal Misra, learned counsel for the petitioner, Shri Dinesh Chandra Srivastava, learned counsel appearing for the respondent no. 3 and learned Standing Counsel for the respondent nos. 1 and 2.
By means of this writ petition, the petitioner seeks quashing of the transfer order dated 06.07.2018 passed by the Joint Director of Education (Basic), Uttar Pradesh as well as the relieving order dated 18.07.2018 passed by the District Basic Education Officer.
The contention of the petitioner is that he had met with an accident in the year 2013 and because of the grievous nature of his injuries, he has still to undergo treatment for which facilities are available at Kanpur.
However, learned counsel for the petitioner could not deny the fact that adequate medical facilities are also available at Mathura. Therefore, the contention of the petitioner that he should not be transferred because of his medical condition does not bear ground.
In view of the aforesaid, we find no good reason to interfere in the order of transfer or in the relieving order.
This writ petition is, accordingly, dismissed.
