Heard learned counsel for the petitioner, learned standing counsel for respondent no. 1 and Sri Arun Kumar, learned counsel for respondent no. 2.
At the very outset, Sri Arun Kumar, learned counsel for respondent no. 2 has produced order dated 2.9.2019 passed by District Basic Education Officer, Gorakhpur by which petitioner was terminated from service and submitted that petition has now become infructuous.
Learned counsel for the petitioner submitted that he may be permitted to withdraw this petition with liberty to challenge the order dated 2.9.2019 passed District Basic Education Officer, Gorakhpur as well as other relief claimed in this writ petition.
Accordingly, writ petition is dismissed as infructuous with aforesaid liberty.
