THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioners being the defendants in a money suit are invoking the writ jurisdiction of this Court for assailing the order dated 13.11.2019, a copy whereof is at Annexure-A, whereby their application filed under Order VI Rule 17 r/w Section 151 of CPC, 1908, having been rejected, the learned II Additional Senior Judge has denied leave to amend the Written Statement.
2. Having heard the learned counsel for the petitioners and having perused the petition papers, this Court declines to grant indulgence in the matter inasmuch as the point as to limitation which arguably hits the suit can be tried as preliminary issue if and when the application in that regard is made by the petitioners regardless of absence of plea as to limitation in their Written Statement.
The writ petition is disposed off with the above observations.
