JUDGMENT / ORDER

The petitioners are four in number. They are differently able person. All of them are below 55 years of age. Their grievance is that in terms of amended Rule 1981 they are eligible for appointment as Assistant Teachers. They claim that they have essential qualification for the appointment of Assistant Teachers as they have passed TET Examination and have also other necessary qualifications. Their only grievance is that ignoring the amended Rule, the respondents are misinterpreting the Government Order dated 15.10.2013 and has held that the petitioners are over age as they are below 50 years of age.
Learned standing counsel was directed to seek instruction on 30.7.2014. He states that he has informed the concerned authorities, but has not received any instructions.
Counsel for the petitioners submits that there is urgency in the matter as next counseling isl likely to commence and in case the petitioners are not considered, they will suffer irreversible loss.
The matter needs consideration. In the meantime, it is provided that the petitioners shall be provisionally allowed to participate in the next counselling and their appointment shall abide by the result of the writ petition.
As prayed, six weeks' time is granted to file counter affideavit. Rejoinder affidavit, if any, shall be filed a week thereafter.
List after expiry of the aforesaid period.
