The petitioner's late father Baijnath Yadav has already instituted a suit, which is pending as Suit No.1170 of 2013, and, now, the petitioner has come up with a prayer that the respondents, who are party in that suit, be restrained from illegally interfering in possession over the suit land.
As the suit is already pending, the petitioner may ventilate his grievance in the suit proceeding. Holding a parallel proceeding would not be appropriate.
With the aforesaid liberty, the petition is disposed off.
