The grievance of the petitioners is that in their appeal filed against an order passed on a recall application, filed by the respondents which was allowed by the trial court the petitioners have also filed an application for interim protection in as much as, the respondents have, during the pendency of the proceedings executed sale deed of the land in a issue in the proceedings.
The stay application has been filed so as to ensure that no further alienation takes place. As many as three dates have been fixed but the stay application has not been disposed of or heard.
Under the circumstances, this writ petition is disposed of directing the appellate court i.e. Commissioner Vindhyachal Division, Mirzapur to consider and pass appropriate orders on the petitioners' stay application on the next date fixed or within a period of 10 days thereafter.
