Heard counsel for the petitioner and Standing Counsel for State of UP.
The present writ petition has been filed for mandamus directing respondent no. 3/ District Magistrate to decide the representation dated 26.7.2019, regarding grant of fire arm licence within specific period as fixed by this Hon'ble Court.
The counsel for the petitioner submits that the petitioner applied for grant of fire arm licence of revolver on 11.3.2011, which was rejected by District Magistrate, Banda by order dated 31.1.2012. Feeling aggrieved by the order dated 31.1.2012, the petitioner preferred an appeal i.e. Appeal No. 80 of 2012 before the Commissioner, respondent-2, which was allowed by order dated 25.2.2013 and the matter was remanded to the District Magistrate to decide the claim of the petitioner for grant of arm licence by reasoned and speaking order after getting fresh police report. In spite of the said order, the application of the petitioner is still pending. Thereafter petitioner moved a representation in this respect on 26.7.2019.
He further submits that the application of the petitioner may be decided within stipulated time as fixed by this Hon'ble Court.
The learned Standing Counsel has no objection to aforesaid submission.
Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to respondent no. 3 to decide the application/representation of the petitioner dated 26.7.2019, expeditiously, preferably within a period of one month from the date of producing a certified copy of this order before the concerned authority, in accordance with law by reasoned and speaking order, provided there is no other legal impediment.
It is made clear that this Court has not adjudicated the claim of the petitioner on merit.
