The instant petition is directed against order dated 30.10.2018 whereby the application of the petitioner bearing paper no. 12 C-2 seeking ad interim injunction during pendency of application for temporary injunction, was rejected by recording a finding that he had not taken steps to serve the defendants despite order dated 5.10.2018 and also that he could not file any documentary evidence to prove that the defendants are raising construction.
After going through the order impugned, I do not find any illegality therein as learned counsel for the petitioner is unable to assail the findings recorded in the impugned order. However the petition is disposed of by providing that after the defendants are served, the trial court shall make endeavour to decide the application for temporary injunction expeditiously, in accordance with law, without granting unnecessary adjournments to the parties.
