Heard learned counsel for the petitioner(s) and learned A.G.A. for the State.
The challenge herein is to a First Information Report dated 14.04.2021 bearing Case Crime No. 206 of 2021 alleging commission of an offence by the petitioners under Sections 419, 420, 467, 468, 471, 504, 506, I.P.C., Police Station- Kotwali, District- Sitapur.
Learned counsel for petitioners informs that petitioner no. 1 and 3 have already been arrested, therefore, he does not want to press the writ petition in so far as the said petitioners are concerned.
Accordingly, the writ petition is dismissed as not pressed in so far as the petitioner no. 1 and 3 are concerned.
On a perusal of the First Information Report impugned herein it can not be said at this stage that no cognizable offence is made out against the remaining petitioners. We are therefore not inclined to quash the First Information Report but without prejudice to the rights of the petitioners in the pending investigation.
In view of the above, the writ petition is dismissed.
