Heard learned counsel for the petitioner, Sri Sahab Tiwari, learned counsel appearing for respondent no.1 and the learned Standing Counsel appearing for the State-respondent no.2.
It is argued by the learned counsel for the petitioner that in spite of the fact that an application for grant of interim injunction was filed by the petitioner in Suit No. 685 of 2010 (Uma Shankar alias Kallan Vs. Nagar Nigam mathura Vrindavan, District Mathura and another) but till date no decision has been taken. It is further argued that in spite of the fact that time and again prayers have been made by the plaintiff-petitioner in the trial court to permit the plaintiff-petitioner to repair his premises in which he is residing. It is also argued that the repairing work of the aforesaid accommodation is urgently required. It is also argued that in spite of repeated request made by the petitioner, no orders were passed in this regard.
Heard learned counsel for the parties and perused the record.
With the consent of the learned counsel for the parties, this writ petition is finally disposed of with the direction to the plainitff-petitioner to file a fresh application along with the self attested computer generated copy of this order downloaded from the official website of High Court, Allahabad before the court below within a period of two weeks' from today. If such an applcation is filed, the court below is directed to consider the same and pass appropriate orders, in accordance with law, preferably within a period of three weeks' thereafter.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
