This Criminal petition is filed under Section 438 of the Cr.P,.C., praying to enlarge the petitioner on bail in event of his arrest in Cr.No.69/2017 of Sadashivanagar P.S., Bengaluru for the offence P/U/S 376, 417 of IPC.
This petition coming on for Orders this day, the court made the following:
ORDER The petitioner apprehends his arrest in Crime No.69/2017 registered by the respondent-police in respect of the offences punishable under Sections.376 and 417 of the IPC. The allegation is, the petitioner and the complainant resided together for the last eight months and he had assured to marry her, but off late avoiding her. He had threatened her through his friend.
2. Learned counsel for the petitioner submits that in fact the petitioner himself had lodged a complaint against the complainant before the Sadashivanagar Police Station and the said case is registered in N.C.R. No- 324/17 and in retaliation to the said complaint, the present complaint is lodged by her. He further submits that petitioner is ready to appear before the investigating officer and co- operate in the further investigation.
3. In the light of the above, the petition is allowed.
The petitioner is granted anticipatory bail, in Crime No. 69/2017 registered by respondent police subject to the following conditions:
He shall appear before the investigating officer forthwith. On that, the investigating officer is at liberty to interrogate and subject him to medical examination. In the event of his arrest, he shall be released on bail on his executing a self bond for a sum Rs.50,000/- with one surety for the likesum to the satisfaction of the investigating officer.
