JUDGMENT / ORDER

The petitioners were aggrieved by the super session order issued at Ext.P2. The primarily the allegation against Ext.P2 is that, there was no notice before super session was ordered. In any event, the petitioners' disqualifications in the elections were stayed by an interim order passed by this Court on 04.09.2012. Some of them are said to have been real. Since, the order is of super session of a Managing Committee, the term is expired merely because some of the Managing Committee had been elected, no super session order can be passed against those persons. 2. In any event, Ext.P2 would stand set aside, without prejudice to the department's right to proceed against any of the persons, if the same is permissible under the Kerala Co-operative Societies Act, 1969.
The writ petition is disposed of.
