Gandhi for the appellant states, under the instruction of his client, that the appellant is ready to deposit the amount of Rs. 6 lacs, which could be said as approximately 1/6th share of the sister, within 2 months from today and out of Rs.6 lacs, Rs.3 lacs will be deposited within one month and remaining Rs.3 lacs within one month thereafter and the appellant is also ready to file undertaking for such purpose.
Hence, Notice returnable on 22nd October, 2013.
On the appellant filing undertaking within one week from today to deposit the amount of Rs.6 lacs with the lower Court as declared before this Court, until the next date, interim relief granted by the trial Court shall continue, but with the clarification that if the amount of Rs.3 lacs is not deposited on or before 19th October, 2013, interim relief granted by the trial Court shall automatically stand vacated.
Direct service is permitted.
