Heard learned counsel for the petitioners and the learned Standing Counsel appearing for the State-respondents.
The petitioners are before this Court for a direction to the Civil Judge (Senior Division), Ghazipur to decide the restoration application dated 30.10.2018 under Order IX Rule 9 CPC arising out of Misc. Case No.71 of 2018/74 (Ujagir Ram and others Vs. Executive Engineer, P.W.D., Block-3, Ghazipur and others) expeditiously.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law, if possible, on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders are passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of one month, thereafter.
