Heard learned counsel for the applicant; Shri Yogesh Singh holding brief of Shri Indrakesh Kumar Sharma, learned counsel for the informant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Udit Singh, with a prayer to release him on bail in Case Crime No.963 of 2019, under Sections- 498-A,323,504 IPC, and section 3/4 D.P. Act Police Station- Katghar City District- Moradabad, during pendency of trial.
Counter affidavit has been filed by learned counsel for the informant bringing on record the charge sheet dated 26.12.2020 filed against the applicant after investigation of the case.The present application was filed on 1.2.2021 but the copy of the charge sheet was not annexed and interim protection was obtained,therefore it appears that there is concealment of material facts.
Keeping in view of the above fact the protection granted to the applicant vide order dated 23.2.2021 is cancelled.
The application is, accordingly, dismissed.
